% 19.07.2019 CM.No.46685/2017 (condonation of delay) 1.
For the reasons stated in the application, the delay of 19 days in filing the review petition, is condoned. The application is disposed of.
Review Pet.No.533/2017 (by the appellant for review of the order dated 27.09.2017) 1.
The present review petition has been filed by the appellant praying inter alia for correction of factual errors that have crept into paragraph 40 of the judgment dated 27.9.2017 passed in a batch of petitions.
2.
Besides the above, Mr.N.S. Dalal, learned counsel for the review petitioner states that the appellant had taken a specific plea in ground '(v)' & '(x)' of the LPA, which ought to have been considered
and discussed in the judgment.
3.
We are not inclined to permit the appellant to re-argue the pleas taken in ground '(v)' & '(x)' of the LPA.
If the appellant has a grievance that the said pleas were not taken into consideration in the judgment, it is for him to seek legal recourse as per law but filing a review petition is not a remedy available to him. 4.
Limited to the first submission made by learned counsel for the appellant that some factual errors have crept in paragraph 40 of the common judgment, issue notice to the respondents. 5.
Learned counsel for the non-applicant/ respondent accepts notice and seeks time to file a reply confined to the above plea. 6.
Reply be filed within four weeks, with an advance copy to the other side. Rejoinder thereto, be filed within four weeks, thereafter. 7.
List on 11.10.2019.
