Learned counsel for the petitioner submits that since some of the stocks lying with the respondent has expired its shelf life as on date, he does not wish to press this. He seeks leave to withdraw the petition reserving his liberty to raise all claims before the Arbitral Tribunal.

The Petition is accordingly dismissed as withdrawn with liberty as prayed for.

This would be without prejudice to the rights and contention of the parties.
