% 22.11.2016 IA.No. /2016(to be numbered) (under Order XXIII Rule 3 CPC) Counsel for the parties submits that parties have entered into an amicable settlement. An application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure has been handed over in Court. Registry is directed to list and number the application.
The plaintiff as also the Director of the defendant are present in Court. They are identified by their counsel. Parties submit that they have entered into an amicable settlement. They identify their signatures on the application. The application is also signed by the counsel for the parties, and is duly supported by the affidavit of the plaintiff and the Director/authorised representative of the defendant company. A copy of the Resolution/Minutes of the Meeting held on 21.11.2016 authorising Shri Mukesh Garg to make a statement in regard to the compromise has also been filed along with the application. Copy of the
settlement agreement is marked as Exhibit P-1. Parties agree to remain bound by the terms of the settlement agreement.
As prayed, the present suit is decreed in favour of the plaintiff and against the defendant in terms of Exhibit P-1.
Since the matter has been resolved through mediation, the plaintiff is entitled to half of the court fee, as prayed. Necessary certificate be issued. The application stands disposed of.
