% 15.09.2017 1.

The petitioner has approached this Court impugning the order dated 8th August, 2017 in case FIR No.466/2013, under Section 308/34 IPC, PS Vijay Vihar, whereby the learned ASJ has passed the following order: "xxxxxxxxxx Perusal of record reveals that the applicant was first ordered to be released on interim bail vide order dated 22.12.14 and thereafter had been seeking extension of bail on one ground or the other. It further transpires that he was last granted interim bail vide order dated 20.3.17 till 25.5.17 and that although applicant did appear in Court on 25.5.17, he never moved any application seeking surrender nor any application seeking extension of interim bail. Consequently he was taken into custody on 5.7.17 when he next appeared. Keeping in view all the aforesaid, this Court is of considered opinion that applicant is not entitled to be released on bail at this stage. Application is accordingly dismissed. On request of ld counsel copy of order be given dasti as prayed." BAIL APPLN. 1795/2017

2.

At this stage, learned counsel for the petitioner seeks leave to withdraw the bail application with liberty to approach the learned Trial Court for grant of regular bail.

3.

The bail application is dismissed as withdrawn granting the liberty as prayed. Dasti as prayed.
