O R D E R

% 15.01.2018 By this petition the petitioner had sought parole on the ground that the marriage of his sister was to be performed. The marriage of the sister of the petitioner was fixed for 11th September, 2017, however inadvertently this petition came up before this Court for the first time on 13th September, 2017 when the learned predecessor of this Court was on leave. Thus, the marriage of the petitioner's sister had already been performed. This Court while renotifying the matter from 8th November, 2017 to 15th January, 2018 called the latest nominal roll of the petitioner from the concerned jail. As per the nominal roll after the jail punishment was provided to the petitioner on 10th April, 2017 the petitioner was directed to be released for a period of four weeks with effect from 31st May, 2017. There is no allegation that the petitioner misused the concession of parole granted to him.

Considering the fact that the petitioner earlier surrendered in time and he was twice granted parole, this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court/ CMM concerned.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent Tihar Jail.
