Learned counsel for the parties state that negotiations have resulted in agreed term of settlement which needs to be put in writing. Learned counsel for the appellants states that only on March 14, 2016 the terms which were agreed orally and through e-mails, have been put in a formal document which has been sent to the respondents.

Learned counsel for the respondents confirms having received the document and states that as counsel having gone through the same he finds the same correctly reflecting the terms of the agreement arrived at orally and through e-mails and is very sure that the document would be agreed to by the respondents requiring both parties to sign the same. FAO(OS) 549/2015

If that be so, we terminate proceedings in the instant appeal recording that if for some reason the settlement fails the appeal could be revived. The reason for the order passed today is that instant appeal lays a challenge to an order declining to issue contempt notice against the respondents. The suit is still pending. The settlement between the parties would embrace the suit. 4.

No costs.
