% 08.09.2017 It is pointed out by learned Counsel for respondents that the consequences which the appellant is complaining against i.e. black listing, is for a limited duration and is confined to the particular work/ tender i.e. supply, installation, testing and commissioning of video conferencing in Media Room at 7 LKM Complex, New Delhi pursuant to tender No.02/SC(E)/DCEC-I/2017-18, dated 18th July, 2017, of which the last date of tender submission was 3rd August, 2017. In other words, the prohibition from bidding/ black listing was confined to the particular items of supply under the subject tender and no other. In view of the above clarification and having regard to the LPA 586/2017

circumstances, learned senior counsel for appellant submits that appellant be permitted to withdraw the present appeal. He, however, seeks liberty to avail of other remedies available in law.

Liberty is granted. The appeal and pending application are accordingly dismissed as withdrawn.
