% 24.11.2017 Matter has been passed over once.

None has appeared for appellant even on the second call.

A perusal of order dated 2nd November, 2016 shows that interim protection of suspension of sentence was ordered to be continued subject to appellant depositing `3 lakhs with the Registrar General of this Court. It was made clear that in case amount was not deposited by the appellant, he would surrender before the trial court. Crl MA 18303/2016 was filed for extension of time by another three weeks for depositing the amount. This application was allowed and time was extended by another three weeks.

Neither the amount was deposited nor appellant surrendered before the trial court.

Instead, CRL MA 19360/2016 was filed for further extension of time for deposit of amount. This application was dismissed vide order dated 15th December, 2016 and appellant was

directed to surrender before the trial court Crl. Appeal 925/2015 and Crl M.B. 7650/2015 was taken up on 17th February, 2017. Appellant did not appear before the Court. In the interest of justice, adverse orders were not passed and matter was adjourned to 14th July, 2017.

Learned counsel for the appellant submitted in the Court on 14.7.2017 that the appellant shall pay `3 lakhs to the respondent. Learned counsel for the respondent submitted that in case appellant makes payment by the next date of hearing, respondent would not pursue this case any further. Matter was adjourned for today. Today neither appellant is present in the Court nor `3 lakhs have been paid to the respondent by now. In exercise of powers of this Court under 482 CrPC, the appeal is dismissed for nonprosecution.
