This Court had by its order dated 19.11.2024 directed the Petitioner/tenant, who was physically present before the Court on that date had made a submission that the parties have reached the settlement and the Petitioner is ready to vacate the subject premises on or before 31.07.2025. The undertaking by way of affidavit was required to be filed by the Petitioner within one week thereafter.

The matter was listed for compliance on 17.12.2024 and thereafter today.

Despite an additional opportunity, the Affidavit has not been filed by the Petitioner/tenant.

Learned Counsel for the Respondent submits that the other directions passed by this Court have also not been complied with by the Petitioner/tenant.

Accordingly, as set out in order dated 19.11.2024, the Respondent/landlord is at liberty to take all appropriate steps for recovery of possession alongwith the use and occupation charges at market rate and any other dues from the Petitioner/tenant, in accordance with law. 7.
