O R D E R

% 11.09.2017 The petitioner had applied for selection for the post of Assistant Commandant in the Central Reserve Police Force. The petitioner has obtained copy of his English paper in which he had secured 44 marks out of 100.

The contention of the petitioner is that he has been wrongly awarded zero mark in respect of answer to sub-question (iv) to question No.3. It is also submitted that the petitioner had awarded '4' marks for su-questions (i) to (vi) to question 3, which was reduced to '3' as there is over-writing by the examiner. Question no.3 related to passages to which answers were to be given by the candidate in his own words with reference to the passage. We have considered the said contention and reject the same for this Court should not wear the shoes of the examiner and re-check or re-evaluate the question paper. We do not think, it will be appropriate and proper for us to on the basis of our assumption and

understanding award marks. The examiner after examining the reply had given zero marks to the petitioner in response to sub-question no.(iv) to question no.3.

The petitioner was awarded three (3) marks for sub-question (i) to (vi), when we add up the marks awarded for each sub-question. The submission of over-writing is, therefore, misconceived. There is no merit in the writ petition and the same is dismissed without any order as to costs.
