O R D E R

% 01.03.2018 After some arguments, the learned senior counsel representing the petitioner submits he may be permitted to withdraw the present petition and the application filed therewith and instead be given liberty to move an application under Order 7 Rules 10 and 11 CPC raising the issue of the plaint not disclosing cause of action and, therefore, meriting rejection. The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. It is clarified that in the event of such application as aforesaid being moved the learned trial Court will take a decision thereupon uninfluenced by the observations recorded in the order dated 22.04.2015 which was impugned by the petition at hand.
