The learned counsel appearing for the respondent submits that the respondent (Indian Council for Child Welfare) is not State within the meaning of Article 12 of the Constitution of India and, thus, the present petition is not maintainable. This is disputed by the petitioner. 4.

Notwithstanding the above, the learned counsel for petitioner submits without prejudice to its rights and contentions that he has instructions to withdraw the show cause notice dated 24.05.2017, with liberty to take such action as available in law within a period of one week from today. 5.

The respondent is bound down to the statement that the impugned

show cause notice shall be withdrawn within a week from today. No further orders are required to be passed in this petition. 6.
