% 29.01.2016 Learned APP for the State has filed the status report in which it has been submitted that Section 409 of the Indian Penal Code has been deleted during the course of investigation and now the case is pending investigation under Sections 420/120B of the Indian Penal Code.
Learned counsel for the petitioner submits that if the chargesheet is filed, the only Sections left will be Sections 420/120B of the Indian Penal Code, which are compoundable. Therefore, learned counsel for the petitioner does not want to press the present petition and wish to withdraw the same with liberty to move the
application for compounding before the Trial Court. The petition and application are dismissed as withdrawn with liberty as prayed for.
