% 26.09.2017 The present testamentary case has been listed on office note. As per the office note the present testamentary case seeking grant of probate was filed on 28th August, 2015. On the same day Registry raised certain objections, however, till date the objections have not been removed. In terms of Rule-5(1) and 5 (2), Part-A (a), Chapter-I, Volume-5 of Delhi High Court Rules, objections are required to be removed within 30 days failing which the petition has to be listed before Court for dismissal for non-prosecution.
Therefore, the petition is dismissed for non-prosecution. MUKTA GUPTA, J.
