HON'BLE THE CHIEF JUSTICE HON'BLE MR. JUSTICE V. KAMESWAR RAO
O R D E R
% 16.11.2018 Petitioner has filed this Public Interest Litigation and the prayer made therein reads as under:
"It is therefore respectfully prayed that this Hon'ble Court may kindly be pleased to:
(1) Issue an order or direction in the nature of writ or pass any other appropriate order thereby directing the respondent no.1 to extend the running hours of Delhi Metro 24x7 in all the phases of Delhi Metro;
(2) In alternate, issue an order or direction in the nature of writ or pass any other appropriate order thereby directing the respondent no.1 to extend the running hours of Delhi Metro till 01.00 PM in all the phases of Delhi Metro by reducing its frequency; (3) Issue an order, direction or writ in the nature of mandamus or
any other appropriate writ to direct respondents to take immediate measures to provide concession in the fare of Delhi Metro to Senior Citizens, physically challenged persons and students of School, college or any other educational institution in the NCT of Delhi; (4) Pass any such order, which this Hon'ble Court deems fit and proper in the circumstances of the case."
To issue a direction for grant of concession and benefit, the matter would lie within the domain of an adjudicating authority. While exercising our extraordinary jurisdiction under Article 226 of the Constitution of India, we see no reason to make any indulgence in the matter. The petitioner may make his grievance before the adjudicating authority and it would be for them to consider the grievance of the petitioner in accordance with law. The petition stands disposed of.
