% 04.09.2015 The petitioner has prayed for quashing of the FIR No.431/2015 (P.S.Sagarpur) instituted for the offence under Section 308 of the Indian Penal Code qua him. It has been submitted that the complainant has named only one person in the first information report and the petitioner was not named. The name of the petitioner transpired only on the statement of one of the co-accused persons of this case. The bonafide of the petitioner, it has been argued, is reflected by the fact that no sooner he learnt about his implication in this case, he surrendered before the police authorities.
Be that as it may, on such ground the present prayer of the petitioner cannot be allowed.
The petitioner is permitted to withdraw this petition in order to enable him to explain his bonafide and innocence to the investigating agency, which would take into account all the points raised by the petitioner and would act in accordance with law. The petition is dismissed as withdrawn with the liberty aforesaid.
