% 17.08.2016 Learned counsel for the respondent submits that without prejudice, the respondent has no objection if the counter claim filed by the petitioner be taken on record and the same be dealt first by the Arbitral Tribunal. Counsel for the petitioner submits that two Arbitral Tribunals have already been constituted and the claims are different. He does not press the present petition. The same is accordingly dismissed as withdrawn. I.A. No.8434/2016 (for preponement of date) Reply has been filed by the petitioner.

The above mentioned application has already been disposed of by order dated 4th August, 2016.
