The learned counsel for the petitioner states that pursuant to the order dated 03.10.2016, the respondent has handed over vacant physical possession of the flat in dispute to the petitioner. He also submits that before the Delhi High Court Mediation and Conciliation Centre, New Delhi (hereinafter referred to as 'the DHCMCC') a Settlement Agreement has been entered into between the parties on 25.08.2017. 2.
The matter was fixed yesterday when the learned counsel for the respondent had appeared and confirmed that the parties had settled the matter vide Settlement Agreement dated 25.08.2017 executed before the DHCMCC.

Today, despite a pass over, none has appeared for the respondent. The Settlement Agreement dated 25.08.2017 is taken on record. Registry is directed to scan the same and place it on record. 4.
Parties are bound by the terms and conditions of the Settlement
Agreement dated 25.08.2017. The respondent is directed to ensure that the terms and conditions of the Settlement Agreement are complied with. 5.
With the above direction, the present petition stands disposed of. JAYANT NATH, J.
