Mr. Anujay Tiwari enters appearance on behalf of the respondents.

1.1 Learned counsel for the respondents says that he does not wish to file a reply as he has no objection to the prayer made in the petition for appointment of an Arbitrator.

1.2 Learned counsel, however, says that rights and contentions of the respondents should be left open on the merits of the dispute. 2.

Counsel for the petitioners also submits likewise i.e. that an Arbitrator be appointed by this Court.

Accordingly, the captioned petition is disposed of with the following directions:- 3.1 Dr. T.R. Naval, Former District & Sessions Judge, Delhi (Mob. No.: 9910384662) is appointed as an Arbitrator in the matter. ARB.P. 840/2018

3.2 The learned Arbitrator will be paid his fee as per the provisions of the Fourth Schedule appended to the 1996 Act. 3.3 The learned Arbitrator before entering upon reference will make a declaration under Section 12(5) and other attendant provisions of the 1996 Act.

3.4 Needless to say it would be open to both the parties to raise their respective contentions on the merits of the matter before the learned Arbitrator.
