% 25.04.2016 I.A. No. 5018/2016 This application has jointly been moved by the parties under Order XXIII Rule 3 CPC to record their settlement.

The application is signed by the representatives of the plaintiffs, defendant No.1 and by the Authorised Representative of defendant No.2. It is also signed by the learned counsel for the plaintiffs and is supported by the affidavit of the constituted attorney of the plaintiff Mr. Amit Sehgal, Mr. Rajendra Jain (defendant No.1) and Mr. Shekhar Jain, the authorised representative of defendant No.2.

The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same. The payment made by the

defendants under the settlement has been encashed by the plaintiffs. The parties shall remain bound by the terms of the settlement. The suit stands disposed of in terms of the said compromise, which shall form part of the decree.
