% 19.04.2016 Review Petition No.190/2016.

The petitioners seek review of the order dated 15th February, 2016 to the extent not granting liberty sought by the petitioners to approach the Civil Court while withdrawing the writ petition.

The petition was withdrawn after lengthy arguments over two days and liberty sought by the petitioners qua the respondents no.1 to 3 was denied for the reasons emanating from the arguments. In fact the petitioners present in Court themselves on 15th February, 2016 and the counsel then appearing for them were informed that this Court was not inclined to grant liberty and the order was passed only after the petitioners and their then counsel exercised choice to withdraw the appeal inspite of liberty sought being denied, rather than have the same disposed of on merits.

With the change in legal advice, the stand taken in Court cannot be permitted to be changed.

No ground for review is made out.

Dismissed.
