Having regard to the nature of the issues pressed by the petitioner, both factual and legal, this writ petition deserves to be listed as Writ Petition (Criminal).

Mr. Sanjoy Ghose, ld. Additional Standing Counsel for the Government of NCT of Delhi points out that the petitioner is W.P.(C) 7979/2017

challenging the vires of Maharashtra Control of Organised Crime Act, 1999 which was enacted by the State of Maharashtra and therefore, the State of Maharashtra would be necessary and proper party for complete and effective adjudication of the subject matter of the writ petition.

We accept the oral request made by Mr. Vivek Sood, ld. Senior Counsel for the petitioner and permit impleadment of State of Maharashtra as party respondent.

Let the amended memo of parties be filed by the petitioner within one day from today.

5.

The Registry is therefore, directed to de-register this writ petition as writ petition (civil) and register the same as writ petition (criminal).

6.

The matter shall be listed on 11th September, 2017 before the appropriate Bench as per roster.
