% 30.11.2015 The petitioner seeks anticipatory bail in connection with FIR No.1089/2015 (P.S.Seema Puri) which was instituted for the offence under Section 408 of the Indian Penal Code.
The petitioner was an erstwhile employer of the complainant. It has been alleged by the complainant that the petitioner had taken 100 Samsung mobile telephones for the purposes of delivering it to a customer at Karol Bagh. Those mobile telephones were neither delivered nor any money was handed over to the complainant.
It has been submitted on behalf of the petitioner that the whole dispute arose because the petitioner, now, has started his own business and is no longer in the employment of the complainant. Such was the submission made by the petitioner in the first instance when the matter was taken up for
consideration for bail. The petitioner was granted interim protection with a direction that he would visit police station as and when required, in the course of investigation of the case.
Today, learned counsel for the petitioner has informed the Court that the complainant has settled his disputes with the petitioner and has entered into a settlement. A settlement deed has been entered into by the petitioner and the complainant.
Considering the aforesaid facts, the interim protection granted to the petitioner is hereby made absolute.
The petitioner would be released on bail on his furnishing a bond in the sum of Rs.10,000/- with two sureties of like amount to the satisfaction of the arresting officer/SHO of the concerned police station. The application is disposed of.
