O R D E R

% 20.09.2016 1.

This revision petition has been preferred impugning the order dated August 04, 2015 whereby the learned Trial Court dismissed the application filed by the petitioner herein.

2.

Vide the above application under Section 91 Cr.P.C., the petitioner wanted the learned Trial Court to summon and preserve the following call detail record w.e.f. September 15, 2014 to October 18, 2014:- Number Service Provider Name 991233554 Vodafone Rishi Prakash 9868421421 BSNL Desh Bandhu 9467665435 BSNL ASI Krishan Kumar of PS Civil Line 9868000217 MTNL HC Ajit Singh of PS IP Estate 965412393 Vodafone Rajat (witness) 9812184175 Idea Anand (witness) CRL.REV.P. 559/2015

3.

During the course of hearing learned counsel for the petitioner submits that grievance of the petitioner shall stand redressed if he is informed whether the call detail record for the period from September 16, 2014 to September 18, 2014 in respect of PWs Rajat and Anand have been collected by the prosecution and if so, copy of the same may be supplied to them.

4.

Learned APP for the State submits that call detail record in respect of the above two mobile numbers 9654512393 & 9812184175 for the period from September 14, 2014 to October 14, 2014 has been obtained. Copy of the call detail record has also been handed over to the learned counsel for the petitioner today in the Court.

5.

Since the limited prayer made before this Court by the petitioner stands granted in the form of furnishing the copy of the call detail record for the relevant period in respect of mobile numbers 9654512393 & 9812184175, learned counsel for the petitioner while not pressing the remaining relief claimed in the revision petition submits that revision petition may be dismissed as withdrawn.

6.

In view of the above, the revision petition stands dismissed as withdrawn.
