HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 20.11.2018 It is stated that disputes between the family members regarding shares in the companies held by the family, gave rise to registration of the present FIR no.126/2017 under Sections 409/420/468/471/120-B IPC at Police Station Moden Town on the complaint of respondent no. 2. A cross FIR No. 77/2018 under Section 408 IPC was also registered at Police Station Model Town against respondent no. 2. It is submitted that petitioners and respondent nos. 2 and 3 have settled their disputes amicably; therefore,

aforesaid FIR, which is at the investigation stage, may be quashed. It is further submitted that cross FIR no. 77/2018 has already been quashed by a Bench of coordinate jurisdiction, vide order dated 20th November, 2018 passed in Crl. M.C. no. 5825/2018. Respondent nos. 2 and 3 are present in Court and have been identified by SI Subhash Chandra of police station Model Town. Respondent nos. 2 and 3 submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion, vide a Settlement Deed/Family Settlement Deed dated 2nd November, 2018 and they have no objection in case aforesaid FIR, which is at the investigation stage, is quashed. Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
