% 17.12.2018 Respondent no.2 has remained unserved. However, respondent no.2 has appeared and has been identified by SI M.K. Manoj of police station Preet Vihar.
Respondent no.2 submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion vide Memorandum of Understanding dated 12.11.2018. He further submits that he has already received settled amount of `98,000/- from the petitioners and has no objection in case FIR No. 92/2011 under Sections 420/468/471 IPC registered at police station Preet Vihar and the consequent proceedings emanating therefrom are quashed.
Keeping in mind the settlement arrived at between the petitioners and
respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
