The petitioner has preferred the present writ petition to assail the order dated 02.11.2018 in C.P. No.602/2018 arising out of Original Application No.3718/2018 passed by the Central Administrative Tribunal, Principal Bench, New Delhi (the Tribunal). The Tribunal has dismissed the said contempt petition while preserving the right of the petitioner to assail the order dated 31.10.2018, whereby the representation of the petitioner

against his transfer was rejected by the respondent. 4.

The petitioner had preferred the aforesaid Original Application assailing his transfer from Bindapur No.2-GBSSS (1618314) (West B) to Madanpur Khadar Extension, J.J. Colony, GBSSS (1925339) (South East). The said Original Application was disposed of on 28.09.2018 with a direction to the respondents to pass a speaking order within thirty days, and till then, the respondent was directed to maintain status quo. Consequently, the order dated 31.10.2018 was passed by the respondents, in compliance with the orders of the Tribunal. Thereafter, the petitioner preferred contempt petition alleging that he had been relieved without passing of the speaking order. The Tribunal has not found merit in the said contempt petition.

We have perused the impugned order and since the Tribunal has chosen not to exercise its jurisdiction to proceed in contempt against the respondents, in judicial review, we are not inclined to interfere with the impugned order.
