% 27.09.2017 Petitioners have prayed for quashing of the complaint case being SC no. 6780/2016 titled Ms. Yashoda vs. Jagga & Ors. pending in the Court of Mr. Ajay Kumar Jain, learned Additional Sessions Judge, Saket Courts, New Delhi under Sections 323/506 IPC and Section 3 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is submitted that complaint case is at the initial stage. Charges have yet not been framed. It is further submitted that petitioners and respondent no. 2 (complainant) are neighbours.
They have settled their disputes amicably,
therefore, aforesaid complaint may be quashed. Respondent no. 2 is present in Court and submits that she has settled the matter with the petitioners of her own free will, voluntarily and without any undue force, pressure or coercion.
Affidavit of respondent no. 2 is also on record. She further submits that she is not willing to pursue the aforesaid complaint and the same may be quashed.
Keeping in mind the fact that petitioners and respondent no. 2 have settled their disputes involved in the complaint at the initial stage, in the interest of justice, SC no. 6780/2016 titled Ms. Yashoda vs. Jagga & Ors. pending in the Court of Mr. Ajay Kumar Jain, learned Additional Sessions Judge, Saket Courts, New Delhi under Sections 323/506 IPC and Section 3 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 is quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
