By this petition, the petitioner seeks parole for treatment of his old mother and repair of the house including construction of toilet inside the house.

A status report has been filed revealing that the family of the petitioner is a joint family residing in their own house. In the house, besides old mother, father, wife, son and younger brother of the petitioner are also residing. Mother of the petitioner is suffering from knee pain and is under treatment from Max Hospital. It is further stated that the repair of the house and the construction of toilet inside the house can be done by son, brother, father and wife of the petitioner.

As per the nominal roll, petitioner was granted parole twice in the year 2016 for a period of four weeks and 21 days respectively. However, in the year 2017 no parole has been granted to the petitioner. W.P.(CRL) 2646/2017

Considering the fact that earlier when the petitioner was granted parole, he surrendered in time and had not misused the concession granted to him, this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his released on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the learned trial court /CMM.

Petition is disposed of.

Copy of this order be sent to the petitioner through Superintendent, Tihar Jail.
