During the course of arguments, learned counsel for the petitioner, on instructions, informed that the petitioner was ready and willing to pay `5 lacs to the complainant without prejudice and subject to future adjustment (if any).

He further informed that he has joined the investigation and has assisted the Investigating Officer to apprehend the co-accused persons. He was able to trace the address of daughter of one of the accused. He ensures that the petitioner shall continue to co-operate and assist the Investigating Agency to apprehend the co-accused persons. On this, complainant has no objection to the grant of bail. 3.
By an order dated 04.09.2015, the petitioner was granted interim protection and was directed to join the investigation as and BAIL APPLN. 1840/2015
when required.
Undisputedly, the petitioner has joined the investigation and has assisted the Investigating Agency to apprehend the absconding accused persons. The petitioner has offered to pay `5 lacs to the complainant to compensate him for the loss suffered by him voluntarily without prejudice and subject to future adjustment (if any).

Considering the facts and circumstances of the case and the offer of the petitioner, he is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, continue to co-operate and assist the Investigating Agency to apprehend the absconding accused persons.
`5 lacs shall be paid by the petitioner to the complainant within four weeks through Investigating Officer by way of demand draft.
In case of non-compliance of the order, the complainant will be at liberty to approach this Court. 5.
The bail application stands disposed of.
