The petitioner has been denied visa to India on the basis of a report submitted by Consulate General of India (CGI) at Houston, USA. The principal allegation against the petitioner is that he has violated the terms of his Visa by indulging in missionary and evangelical activities. This, according to the respondent is apparent from the posts at certain websites; the information of which will be provided to the petitioner. 2.

In terms of the order dated 15.12.2016 passed by this Court in W.P. (C) 6189/2016, the petitioner was permitted to make a representation to the CGI at Houston (incorrectly mentioned as Arkansas) and the CGI was directed to dispose of the same in accordance with law. 3.

The learned counsel for the respondent submits that after information was provided, no representation was made. In this view, the petitioner may send a representation to the Joint Secretary, Ministry of Home Affairs,

Government of India, Foreigners Division (as this Court is informed that the concerned authority for disposing of the same would not be the Consulate General at Houston but the Ministry of Home Affairs). The petitioner is also at liberty to request for permission to visit India to wind up his business. The concerned authority may also consider this request even if the order of cancelling petitioner's visa is sustained.

The petition and application are disposed of with the aforesaid observations.
