By way of this application under Section 439 Cr.P.C, the petitioner is seeking regular bail in case FIR No.406/2017, registered under Section 354/354(B) at PS Bhalswa Dairy.

Notice. Learned APP as above accepts notice on behalf of the State. 3.

Learned counsel for the petitioner submits that petitioner is 19 years old and he is in custody since 14th July, 2017. The parties are neighbours and the shirt of the complainant was allegedly torn when the complainant, who is 16 years old, tried to free herself from the grip of the petitioner. It has also been submitted that the matter has not been immediately reported to the police which is also mentioned in the FIR. BAIL APPLN. 1936/2017

The petitioner is 19 years old and even as per FIR he expressed his love for the complainant who is 16 years old and thereafter the allegations are that when the complainant went upstairs to bring back her niece, aged about 3 years, from the house of the relative of the petitioner, at that time she was allegedly caught by the petitioner and her breast was pressed. 5.

In the facts and circumstances, the petitioner is admitted to bail on his furnishing personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/Link Court subject to the condition that the petitioner shall not try to contact or influence the witness.
