HON'BLE MS. JUSTICE REKHA PALLI

% 11.12.2018 1.
Vide the present petition, the petitioner seeks anticipatory bail under Section 438 of the Cr.P.C. On 16th November, 2018, this Court while directing the petitioner to appear before the investigating officer on 17th November, 2018 had directed that subject to the petitioner joining interrogation, no coercive steps be taken against him. A status report has been filed by the State confirming the fact that the petitioner has duly joined the investigation. 2.
Having considered the nature of the allegations levelled against the petitioner and his conduct in joining investigation as directed by this Court, but without commenting on the merits of the case, I am of the view that the petitioner has made out a case for being granted anticipatory bail.
3.
Accordingly, it is directed that in the event of arrest till the
filing of chargesheet, the petitioner will be released on bail, subject to his furnishing a personal bond in the sum of Rs.25,000/- with a surety of the like amount to the satisfaction of the Investigating Officer. The petitioner will not leave the NCR without the prior permission of the Investigating Officer and will not try to contact any of the witnesses or hamper the investigation in any manner. The petitioner will also furnish two mobile phone numbers on which he can be contacted to the Investigating Officer. The aforesaid mobile numbers will be kept operational at all times.
4.
Needless to state that the observations made herein above are only prima facie and will not have a bearing on the trial. 5.
The application is disposed of.
