IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 3490/2018 LAXMI & ANR ..... Petitioners Through:

None.

versus STATE (NCT OF DELHI) ..... Respondent Through:

Ms Richa Kapoor, ASC with Ms Shivani Sharma and Mr Chaitanya Bansal, Advocates.

Mr Zoheb Hossain, Advocate for UIDAI.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 19.09.2019 1.

None is present on behalf of the petitioners. 2.

The petitioners have filed the present petition, inter alia, praying that directions be issued to the respondent to provide protection to them. The petitioners claim that they married against the wishes of the family members of petitioner no.1.

3.

In order to support their contention that the petitioners are major, they had provided details of their Aadhar Card. An affidavit has been filed on behalf of Unique Identification Authority of India which indicates that one of the Aadhar Cards produced by the petitioners is fabricated, and the correct date of birth of petitioner no.1 is 23.09.2002. 4.

Notwithstanding that petitioner no.1 is a minor, the petitioners would

be entitled to protection against any harm at the hands of their family members.

5.

In view of the above, this Court directs that in the event the petitioners approach the concerned SHO, he shall evaluate the threat perception and take steps for their protection as necessary. 6.

It is clarified that nothing stated in this order shall be read as precluding the concerned authorities from taking any steps as required as per law, on account of petitioner no.1 being a minor. 7.

The petition is disposed of with the aforesaid observations. VIBHU BAKHRU, J SEPTEMBER 19, 2019 RK
