% 12.09.2017 Learned counsel for the petitioner submits that the petitioner wants to cross examine PW-24 SI Pawan Kumar. Learned APP has opposed the petition, he however submits that if the petitioner would cross examine PW-24 on the next date of hearing, the matter would proceed smoothly.

Looking into the above facts and circumstances, the present petition is allowed to the extent that IO PW-24 SI Pawn Kumar shall be cross examined on the next date of hearing on two documents namely the Identity Card of the deceased and Admission Ticket. Impugned order dated 1st August, 2017 is set aside to the extent thereby allowing cross examination of PW-24 at the hands of petitioner on 16th September, 2017.

Court below is directed to summon PW-24 for the said date on

filing of PF by the petitioner.

Instant petition stands disposed of in the above terms. Copy of order be sent to the trial court forthwith. Copy of order be also dasti to the parties.
