% 25.09.2017 The petitioner seeks bail in connection with FIR No.228/2017 dated 27.07.2017 (P.S.Sonia Vihar) instituted for the offence under Section 33 of the Delhi Excise Act, 2009.
The petitioner is said to be in custody since 28.07.2017. It has been alleged that on 27.07.2017, the petitioner tried to forcibly come out of check point even when the vehicle was signalled to stop by the constable on duty. On chase, the vehicle was apprehended and 30 boxes of illicit liquor was recovered from the car.
Ms.Neelam Sharma, APP while opposing the bail has submitted that the petitioner has been involved in similar nature of offences in the past. However, taking into account the period of custody and the nature of accusation, this Court is inclined to grant bail to the petitioner.
The petitioner is directed to be released on bail, on his furnishing a bond in the sum of Rs.10,000/- with two sureties of the like amount to the satisfaction of the Trial Court.
The application is disposed of.
