By way of this petition filed under Article 226 of the Constitution of India, read with Section 482 Cr.P.C. the petitioner is seeking quashing of FIR 92/2017 registered at PS Vikaspuri, under Sections 354A/509 IPC on the basis of settlement between the parties.

The affidavit of the complainant in respect of the settlement with the petitioner is annexed with the petition at page 30. Though the affidavit has been sworn by the complainant but the same is not even having the date and month on which it was sworn.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the writ petition with liberty to file the fresh writ petition annexing therewith the settlement between the parties. 4.

The writ petition is dismissed as withdrawn, granting the liberty as prayed.
