% 15.09.2017 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court and accepts notice. He has been identified by SI Ved Parkash, P.S. Malviya Nagar. He submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion vide Memorandum of Settlement dated 21st August, 2017. He further submits that he is not willing to pursue the FIR No.331/2015 under Sections 308/452/34 IPC, Police Station Malviya Nagar against any of the petitioners any further and the same may be quashed.
Keeping in mind, the nature of offence and the fact that settlement has
been arrived at between the petitioners and respondent no.2, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. No.331/2015 under Sections 308/452/34 IPC, Police Station Malviya Nagar and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
