The learned counsel appearing for the respondent states that Justice (Retired), Sadanand Mukherjee, Patna High Court would be appointed by the CMD to adjudicate the disputes between the parties. In the event Justice (Retired), Sadanand Mukherjee is unable to accept the appointment, Justice (Retired) Deerendra Mishra, Patna High Court would be appointed as the Arbitrator within a period of one week from today. 2.

In view of the above statement, the petitioner does not press this petition and seeks to withdraw the same.

The petition is dismissed as withdrawn.
