% 25.09.2017 The liability on account of loan for acquisition of motor vehicle was undertaken even while the claim petition was pending inquiry before the tribunal. Clearly, the appellant depended on his earnings from the employment in which he has continued despite the injuries. There is no document worth the name shown indicating the finance required for sending the son abroad, not even any clarity as to the nature of the course he is to join, the time schedule for such purposes etc. The counsel further concedes that match for the marriage of the daughter, another reason pressed for premature release of the amount put in fixed deposit, is yet to be settled, leave alone the event being scheduled.

In above facts and circumstances, the view taken by the tribunal in the impugned order dated 25.07.2017 denying the premature release cannot be faulted.

The petition is dismissed.
