% 01.11.2017 Petitioner no.2 is wife of petitioner no.1. It is submitted that there was some financial transaction between petitioner no.1 and respondent no.2. Disputes arose between them which led to registration of FIR 89/2012 under Sections 467/406/471/419/420 IPC at PS Connaught Place on the complaint of respondent no.2. A civil suit was also filed by respondent no.2 against petitioner no.1.
It is submitted that now petitioner no.1 has settled the disputes with respondent no.2.
Respondent no.2 is present in Court and has been identified by SI Deep Sharma of PS Connaught Place. He admits having settled the dispute with the petitioner no.1 in terms of settlement dated 4th August, 2012. Affidavit of respondent no.2 confirming compliance of terms of settlement has been placed on record as Annexure P-6 running from page 113 to 116.
Respondent no.2 has identified his signatures on the affidavit Annexure P-6. Respondent no.2 further submits that the post date cheques bearing no.35052 dated 25th April, 2013 for `1 lakh has already been encashed. He says that he has withdrawn the civil suit filed by him and has no objection if the aforementioned FIR is quashed.
Keeping in mind the facts and circumstances as detailed above, more particularly the fact that petitioner no.1 and respondent no.2 have settled their disputes, in the interest of justice FIR No.89/2012 under Sections 467/406/471/419/420 IPC registered at PS Connaught Place and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
