O R D E R

% 23.01.2018 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.475/17 under Sections 376D/506/34 IPC registered at Police Station Mehrauli. Status report is on record. (2) I have heard the learned counsel for the parties including the learned counsel for the complainant and have examined the file. By an order dated 13.09.2017, the petitioner was granted interim bail and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the investigation. BAIL APPLN. 1837/2017

(3) Learned counsel for the complainant has no objection to the grant of bail to the petitioner. The prosecutrix is aged 26 years. The investigation is complete and charge-sheet is stated to have been filed. During investigation, the prosecutrix informed the Investigating Agency that the complaint was lodged by her in anger and she was not interested to proceed with the FIR. The prosecutrix was called to enquire about it and she supported her letter dated 17.08.2017 and requested to close the case.

(4) The prosecutirx and the petitioner were acquainted with each other. Physical relations took place between the two albeit on the alleged promise to marriage.

(5) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `50,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.

(6) The bail application stands disposed of.
