% 13.10.2017 I.A.No.11885/2017 Present application has been filed on behalf of the plaintiff under Order XXIII Rule 1 read with Section 151 CPC for withdrawal of the suit.

In the application, it has been stated that the plaintiff wishes to withdraw the present suit to file a fresh suit for declaration, partition, rendition of accounts and permanent and mandatory injunction after incorporating certain amendments.

Consequently, the application is allowed and the present suit is dismissed as withdrawn.
