% 26.11.2018 In view of the Judgment of this Court in HPL (India) Limited & Ors. Vs QRG Enterprises and Another (2017) 238 DLT 123 (DB), the present appeal cannot be entertained, having regard to the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015.

Furthermore, the Court also notices that the judgment in Harmanprit Singh Sidhu Vs. Arcadia Shares & Stock Brokers Pvt. Ltd. 234 (2016) DLT 30 (DB) highlights that the appeal is also not maintainable in view of the Section 37 of the Arbitration & Conciliation Act, 1996. The appeal is rendered infructuous.
