O R D E R

% 15.09.2017 Learned APP for the State on instructions of the Investigating Officer submits that there was a property dispute between the petitioner and complainant. The co-accused Mukesh Tyagi is a property dealer. Petitioner asked him to get the property vacated at any cost. Mukesh Tyagi hired coaccused Deshraj and Navprabhat to kill the complainant, accordingly, coaccused Deshraj and Navprabhat fired at the complainant in order to kill her. Petitioner has been falsely implicated.

Mukesh Tyagi has already been granted bail by the Bench of co-ordinate jurisdiction vide order dated 24th August, 2017 passed in Bail Application No.1625/2017. In the FIR, complainant had only expressed her suspicion about the involvement of

petitioner. In the CCTV footage, presence of petitioner at the spot is also not recorded. Complainant has sustained only simple injuries. It is further submitted that petitioner is in jail for the last 03 months i.e. from 19th June, 2017.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
