% 02.02.2018 CM APPL.4134/2018 (for directions) By this application, the revision petitioner seeks permission to vacate the premises. It is noted that the revision petition was filed to assail the eviction order passed by the rent controller on the petition of the respondentlandlord against the petitioner-tenant. It was submitted on behalf of the petitioner on 20.09.2017 that the petition was not pressed on merits and was instead withdrawn. Notice was issued to the respondent on the limited question of enlargement of time for vacation. By order dated 02.11.2017 with the consent of the respondent, the petitioner was given time to vacate on or before 31st October, 2018, subject to certain conditions. If the petitioner is inclined to vacate and handover the premises to the respondent, there is no inhibition against suitable steps to that effect being taken by him. The order dated 02.11.2017 does not oblige RC.REV. 438/2017
him to remain in possession till 31.10.2018. All that he is to do is to approach the rent controller and handover the possession to the respondent in terms of the eviction order.
The application stands disposed of with these observations. These proceedings stand closed.
