% 03.11.2017 Learned APP submits that apart from petitioners, Mr. Mayank Shrivastav and Mr. Varunendra Kathura have also been named in the FIR and are accused.

On the oral prayer made by learned counsel for the petitioners, they are impleaded as respondent nos. 3 and 4, respectively. Amended memo of parties be filed during the course of the day. Respondent no. 2, Pawan K.S. Bhargava, is present in the Court and has been identified by Inspector Rajesh Vijay of DIU/Rohini Court. Respondent no. 2 submits that he was working with SAB News Media House Ltd. Petitioners are the Directors of SAB News Media House Ltd.; whereas respondent nos. 3 and 4 were employees in the said company. He submits

that disputes arose between him and petitioners as well as respondent nos. 3 and 4 with regard to payment of some financial transaction relating to the employment. Accordingly, he lodged an FIR No. 846/2007 under Sections 406/417/418/419/420/468/471/500/34 IPC at Police Station Prashant Vihar. Respondent no. 2 says that he has settled the matter with the petitioners of his own free will, voluntarily and without any undue force, pressure or coercion. He further submits that he is not willing to pursue the FIR against the petitioners and other co-accused, that is, respondent nos. 3 and 4. He further submits that FIR may be quashed against all the accused persons, that is, petitioners and respondent nos. 3 and 4. Affidavit of respondent no. 2 has also been placed on record at pages 37 and 38. Respondent has admitted his signatures thereon.

Keeping in mind the facts and circumstances as detailed above, FIR No.846/2007 under Sections 406/417/418/419/420/468/471/500/34 IPC registered at Police Station Prashant Vihar and the consequent proceedings emanating therefrom are quashed.
