O R D E R

% 19.09.2017 It is submitted that petitioners and respondent no.2 have settled their disputes amicably vide a Settlement Deed dated 9th August, 2017; therefore, FIR No.56/2008 under Sections 103/104 of Trade and Merchandise Marks Act, 1958 and Section 63 of Copy Right Act, 1954 registered at police station Economic Offences Wing, may be quashed. Mr. Sheel Kumar Bansal, Authorized Representative of M/s. Laboratoire Garnier & CIE (respondent no. 2) is present in Court and admits that settlement has indeed

been arrived at between the petitioners and respondent no. 2. In fact, he is the signatory to the Settlement Deed. Allegations in the FIR are that the petitioners and other accused were selling counterfeit "Garnier products". Matter has now been settled amicably between the parties. Mr. Sheel Kumar Bansal, Authorized Representative further submits that respondent no. 2 is not willing to pursue the FIR any further and the same may be quashed.

Keeping in view the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in the interest of justice, FIR No.56/2008 under Sections 103/104 of Trade and Merchandise Marks Act, 1958 and Section 63 of Copy Right Act, 1954 registered at police station Economic Offences Wing and the consequent proceedings emanating therefrom are quashed qua the petitioners only.
