This Rent Control Revision Petition under Section 25B(8) of the Delhi Rent Control Act, 1958 impugns the order [dated 1st April, 2017 in RC/ARC No.434/2016 of the Court of ACJ/CCJ/ARC (East), Karkardooma Courts, Delhi] of eviction, after full trial, of the petitioner / tenant from a shop in property No.C1/3, Krishna Nagar, Delhi. 2.

After full hearing, the counsel for the petitioner / tenant, under instructions from the petitioner / tenant present in Court states that the petitioner / tenant does not want to press this petition and withdraws the petition and confines the relief only to grant of time of upto five years to vacate the tenancy premises. It is further stated that the petitioner / tenant is in exclusive control and possession of the premises and is in a position to furnish an undertaking to this Court.

I have cautioned the counsel for the petitioner / tenant that the respondent is unlikely to agree to five years time and this notice is being issued on the understanding that the petitioner / tenant would be granted maximum time to which the respondent is agreeable. RC.REV. 428/2017

Issue notice limited to the aforesaid aspect to the respondent by all modes including dasti and through the advocate for the respondent before the Trial Court returnable on 11th October, 2017. Dasti under signature of Court Master.
