% 24.08.2018 By this petition under section 482 Cr.P.C., petitioners have prayed for quashing of summoning order dated 14th October, 2014 passed by the learned Metropolitan Magistrate, North District, Rohini Courts, Delhi in Complaint Case No.101/1 under sections 109/313/323/452/506/34 IPC registered at police station Samiapur Badli.
Petitioners have also prayed for quashing of the complaint case pending before the Metropolitan Magistrate, North District, Rohini Courts, Delhi.
It is submitted that petitioners (accused) and respondent no.2 (complainant), during the pendency of the petition, have settled their disputes amicably. Petitioners and respondent no.2 are present in the
Court along with their counsels. Respondent no.2 says that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion and he has no objection in case the complaint case no.101/1 under sections 109/313/323/452/506/34 IPC registered at police station Samiapur Badli, is quashed. Keeping in view the settlement arrived at between the petitioners and respondent no. 2 voluntarily, the aforesaid complaint case and consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
